The following general conditions of sale, hereinafter, GCS that offers the sale of cosmetic products of the brand MYOKŌ, available for shipment to Spain and Worldwide. The order placed through the myokobeauty.com website, implies the irrevocable and complete acceptance of these GCS by the customer making a purchase. The GCS are subject to modification at any time, so the applicable GCS will be those that are in force at www.myokobeauty.com on the date on which the Customer makes the order and, also, which can be accessed from the email acknowledging receipt of said order.

THE CLIENT

MYOKŌ offers the sale of products to non-professional customers, over 18 years of age. Sales are retail and for strictly personal use.

Consequently, MYOKŌ limits the order to ten (10) units of the same reference. In general terms, MYOKŌ reserves the right to deny an order that has an abnormal character, in particular in case of order of quantities or unusual amounts for an end consumer.

PRODUCTS

Products available for sale on www.myokobeauty.com are described and presented as accurately as possible (specifications, illustrations, composition, etc.). The customer has the possibility of knowing precisely the product by going to the technical sheet.

PRICE

The price of the Products will be the one stipulated at the time of the order at www.myokobeauty.com, and may be subject to variation with respect to the last order

The prices include the applicable VAT but will not take into account the shipping costs. These Shipping Costs will be indicated to the Customer on the validation page of the basket as well as on the recapitulative page of the order, before validating and paying for the order.

ORDER

ORDER PROCESS

The Client must select the Products he wishes to buy and put them in the shopping cart by clicking on the “Add to cart” button. At any time, the Customer can delete the Products on the display page of their shopping cart, by going to the “Shopping cart” icon available on all pages of the myokobeauty.com and located in the upper right part of the screen.

Upon confirmation of the shopping cart, the Customer must identify himself with his username and password. In the case that it was his first order, the Client must create a client account by completing the registration form. MYOKŌ will not be responsible for errors and / or material inaccuracies related to the information provided by the Client. The registration is reserved only to those people who have a delivery address in the territory while the creation of a customer account is linked to an order. The client account will facilitate access to a private area that will essentially allow tracking orders.

To finalize your order, the Customer must:

– Confirm your delivery and billing address, or indicate a new delivery address in the Territory and / or billing.

– Read the terms and conditions set out in the MYOKŌ Privacy Policy and accept them explicitly by clicking on the corresponding box before paying your order.

– Read these general conditions of sale and accept them explicitly by clicking on the “before making your order payment.

– Pay the amount of your order giving access to the secure payment system of your order.

– Once the payment is confirmed, the Customer will immediately receive an email confirming his order.

AVAILABILITY OF PRODUCTS

All orders for products are subject to their availability. Information on the availability of the Products is provided at the time of order, on the Product page.

Any order will be accompanied by free samples.

CANCELLATION OF THE ORDER

Once the payment has been made, the Client can modify his order by clicking on the “Modify his order” button in the “My orders” section of the private area, provided that the order is still in preparation. If this functionality does not appear in the “My orders” section, it would mean that the order has been sent and, therefore, that it could not be modified or canceled. However, the Client always has the power to use his right of withdrawal described in the right of withdrawal of these general conditions of sale.

MYOKŌ reserves the right to refuse to execute the order in case of conflict with the Client.

In such cases, the Customer will be informed by email of the cancellation of his order and will be reimbursed the amounts that, if applicable, he has paid prior to the cancellation of his order by MYOKŌ.

 

PAYMENT

Payment of the order will be made by Visa, MasterCard, American Express, Apple Pay, Google Pay and PayPal are accepted. You can also use any payment method that is clearly announced on our website.

MYOKŌ has established a secure payment system for any order placed on myokobeauty.com. Payments are made on an external platform through a payment service provider, complying with PCI DSS security regulations.

The Client will receive his invoice by email.

DELIVERY AND RECEPTION OF PRODUCTS

MYOKŌ delivers the Products ordered in Spain and Wordlwide. A single delivery method is guaranteed within a maximum period of fifteen (15) calendar days from the receipt of the Order Confirmation email.

The Customer will be informed by email when the Carrier takes care of the package as well as the specific delivery date.

The information on the delivery conditions will also be accessible from the validation page of the basket, as well as from the recapitulative page of the order, before payment of the latter. No delivery will be made by MYOKŌ before the full price is charged.

Shipping costs must be added to the total price of the order.

PRODUCT RECEPTION

At the time of delivery of the order, if the Customer detects apparent defects in the product, you must immediately contact the Customer Service of www.myokobeauty.com, within a maximum period of 48 hours from the reception of the same.

RIGHT OF WITHDRAWAL AND RETURNS

MYOKŌ offers the Customer the possibility to withdraw from the order, without any reason. The customer will have 14 calendar days to communicate their right to return a product. Returns will not be accepted after 14 calendar days from receipt of the order.

Previously, the client must indicate his intention by email addressed to help@myokobeauty.com, indicating in the Subject field: “Return”, or by calling 910.583.564, where he will indicate the procedure to follow.

– The product will be returned in perfect condition, in its original “packaging”, accompanied by the original invoice or purchase ticket.

– The buyer must meet the direct return costs and, where appropriate, compensate the damage of the object of the purchase. The return costs are borne by the customer or consumer.

– The buyer must send the product or products back to our facilities to the following address: C / Loeches 1-3, 3 i, 28008 Madrid

Once the merchandise is received, the money will be returned through the same payment method that was carried out in the purchase. The return of the money will be made within a period of no more than 10 days after receiving the item or items to be returned. In no case will the amount of the purchase be paid, until verifying the perfect state of the merchandise and “packaging” of the product in our facilities for verification, in case it is the case of non-return products or they would have suffered a depreciation of its value for improper use.

As these products are subject to exclusion from the right of withdrawal for reasons of health or hygiene protection, the return may not take place in any case if the products were unsealed, except for products with a manufacturing defect. They must be returned in their original packaging and in perfect condition, because the goods could suffer some depreciation of their value.

In any case, MYOKŌ will notify the Customer by email of the acknowledgment of receipt of said withdrawal decision.

LIMITATION OF LIABILITY

MYOKŌ will not be liable for the breach of any of its obligations if the breach of the contract results from a case of force majeure, a fact attributable to the Client or any act of a third party that could not have been foreseen or was unavoidable.

LEGAL GUARANTEES

LACKS OF CONFORMITY AND HIDDEN VICES

All products offered through the website are completely original, unless otherwise indicated in their description.

All of them have a guarantee period, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

The Client has a right of access and rectification to the personal data that concern him according to the applicable legislation. These conditions will be governed by Spanish law in the event that any conflict or discrepancy arises in the interpretation or application of these general conditions, in front of a consumer.

In the case of a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Madrid (Spain).

Conditions of Access and Use

The conditions of access to the website are subject to the legal provisions in force at all times as well as to the principles of good faith and lawful use by the User, expressly and strictly prohibiting any type of action that could be detrimental or detrimental to our online or third party store.
